Governor Rick Perry Says Texas May Refuse Obamacare

AUSTIN — Gov. Rick Perry, raising the specter of a showdown with the Obama administration, suggested Thursday that he would consider invoking states’ rights protections under the 10th Amendment to resist the president’s healthcare plan, which he said would be "disastrous" for Texas.

Interviewed by conservative talk show host Mark Davis of Dallas’ WBAP/820 AM, Perry said his first hope is that Congress will defeat the plan, which both Perry and Davis described as "Obama Care." But should it pass, Perry predicted that Texas and a "number" of states might resist the federal health mandate.

"I think you’ll hear states and governors standing up and saying 'no’ to this type of encroachment on the states with their healthcare," Perry said. "So my hope is that we never have to have that stand-up. But I’m certainly willing and ready for the fight if this administration continues to try to force their very expansive government philosophy down our collective throats."

Sarah Palin recently signed a joint resolution declaring Alaska's sovereignty under the Tenth Amendment to the Constitution:
Be it resolved that the Alaska State Legislature hereby claims sovereignty for the state under the Tenth Amendment to the Constitution of the United States over all powers not otherwise enumerated and granted to the federal government by the Constitution of the United States.

Be it further resolved that this resolution serves as Notice and Demand to the federal government to cease and desist, effective immediately, mandates that are beyond the scope of these constitutionally delegated powers.

Similarly, South Carolina also has such a resolution on the table, declaring a seemingly little known fact of American History:

Whereas, the Tenth Amendment to the United States Constitution provides that "powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people"; and

Whereas, the Tenth Amendment defines the limited scope of federal power as being that specifically granted by the United States Constitution; and

Whereas, the limited scope of authority defined by the Tenth Amendment means that the federal government was created by the states specifically to be an agent of the states; and

Whereas, currently the states are treated as agents of the federal government; and

Whereas, many federal mandates are directly in violation of the Tenth Amendment to the United States Constitution ...

I do believe Obamacare is on its way to failure. But, if it doesn't fail, it will be interesting to watch the States Rights drama play out.

This is another trick played on the ta;k radio rubes. This 10th Amendment BS will never stand up in court.

I saw a movie years ago called Soylent Green. The government decided when we should die. We all thought it couldn't happen but now it's coming true.

I have READ the entire Obama healthcare bill. ON Pages 425 - 430 it points to EUTHANASIA or something close to that! This was done once in history and it didn't turn out too well.

•PG 425: Government provides approved list of end-of-life resources, guiding you in how to die.
•PG 429: “Advanced care consultation” will include an ORDER for end of life plans. AN ORDER from the Government to end a life!

I am concerned not only about end-of-life issues, but also beginning of life issues. For example, ordering the murder of pre-born babies with disabilities. As Scrooge said, "Go ahead and let them die, and decrease the surplus population."
I was raised to believe in this Country, to have pride and know we had freedom.
This would also ending the life of the elderly!
For the 1st time in my life, I am SCARED of living here and feel we have lost our freedoms. I am FAR from alone in this.
Nobody should decide IF or how much treatment we get for any illness or how much except those who are ill. NOBODY HAS THAT RIGHT but GOD!
THIS BILL must be stopped!

By the way Obama and those in Washington will NOT have the same plan. If BO's family is ill they will get the best care possible and you can bet your last dollar that if his wife got cancer she would get cancer treatments.

Yes we live in Texas and right now, it wouldn't hurt my feelings one bit if we were separate from the USA since Obama is in control.
