DOJ to Give KSM the NYC Show Trial He Wants; Obama Warns Against Congressional Investigation of Ft. Hood Massacre

More terrorist pandering and abject hatred for Americans from the Obama administration.

Michael Mukasey, the attorney general at the end of President Bush's second term, ripped his successor's decision to prosecute the Sept. 11 conspirators in a federal court, saying the trial will give jihadists a forum and could compromise delicate intelligence.

Mukasey, in an interview with Fox News, called the civilian trial announced Friday by Attorney General Eric Holder "the wrong place, under the wrong circumstances, in the wrong forum."

"After 9/11, we recognized that we were at war," he said, arguing that military tribunals were created for this kind of case and noting that they have been used since the Revolutionary War and during and after World War II.

"There are forums that allow the presentation of evidence in a controlled atmosphere, where you can limit access to classified information, and where you can receive evidence gathered on the battlefield, not necessarily under the kinds of conditions in which police gather evidence in a conventional case," he said. "That's not true in federal court."

The decision to do this is a proclamation that 9/11 was not an act of war. Holder is doing this because it is exactly what terrorists want and doing exactly what terrorists want comprises the majority of Holder's career accomplishments. He is doing this in order to persecute the Bush administration for abiding by federal and international law.

The defendants are not American citizens, so they should not be tried in civilian court anyway, yet that constitutes the crux of Holder's argument for doing this.

Holder said he decided to seek justice against the suspects in federal court rather than a military tribunal because the attacks targeted civilians on U.S. soil. But Mukasey and other critics say the attack was an act of war that should be prosecuted in a military tribunal.

Holder's explanation is neither here nor there. Who the victims happen to be is 100% legally irrelevant. This is a contrived argument regarding jurisdiction. The issue is whether the defendants are American citizens, not where the attack took place. Military tribunals were established for the express purpose of prosecuting non-citizens for terrorist attacks here or abroad. To prosecute them in federal court defies legal precedent.

This is about the defendants' detention, not the mass murders they committed. Holder is putting the Bush administration and the intelligence community on trial. The main argument in favor of military tribunals is to keep important intelligence out of the public domain. They were established in the interest of national security, for which Holder has no concern, hence his ongoing crusade against those who have kept us safe and those continue to keep us safe.

And now this, straight from Obama's mouth (boldface mine):

President Obama on Saturday urged Congress to hold off on any investigation of the Fort Hood rampage until federal law enforcement and military authorities have completed their probes into the shootings at the Texas Army post, which left 13 people dead.

On an eight-day Asia trip, Obama turned his attention home and pleaded for lawmakers to “resist the temptation to turn this tragic event into the political theater.” He said those who died on the nation’s largest Army post deserve justice, not political stagecraft.

He wants no real investigation at all, as with ACORN, hence his attempt to undermine any and all accountability for the failures that led to the Fort Hood massacre. He wants to give all the agencies involved a chance to cover their asses so that his administration can't be held accountable, even though he has done everything he could to weaken the intelligence community ever since he took office and the blame for Fort Hood lies squarely on him.

So don't investigate the military and intelligence failures that led to the slaughter of 14 Americans and injuries to 38 more because their families don't deserve justice and there's no point in trying to prevent acts of terrorism in the future (even though it is certain to happen again, and much worse, because Fort Hood was likely a test run for something larger, given all of Hasan's al-Qaeda ties, his sheer brazenness, and his Pakistan connections), but give the mastermind of the murders of 3000 Americans a show trial to contest his detention even though he's not an American citizen in order to persecute Bush and the intelligence community for keeping us safe for 7 years, and compromise crucial intelligence to boot. Basically, Obama wants to "be clear" in his position that terrorism and murdering Americans are to be encouraged, but preventing terrorism and punishing mass murderers for war crimes when they commit them is verboten. I can reach no other conclusion from the administration's actions.

Obama has demonstrated more loyalty to al-Qaeda than to America, and for that he should be tried for treason, but not before he is made to prove his US citizenship, and if he can't then he should be tried in a military tribunal. That's my idea of justice and it happens to be the military's, too.
